1. Scope of Services
Harbor Point Marketing provides marketing, automation, and business growth services for online businesses, including but not limited to:
- • Website optimization and funnel development
- • SEO and content strategy
- • Email and SMS marketing systems
- • CRM setup and automation
- • Traffic strategy and implementation
- • Conversion rate optimization
- • Consulting and growth strategy
All specific deliverables, timelines, and scope will be outlined in a separate agreement, proposal, or invoice prior to project initiation.
2. No Guarantees / Performance Disclaimer
While we strive to deliver high-quality results, we do not guarantee specific outcomes, including but not limited to:
- • Revenue increases
- • Lead generation results
- • Search rankings
- • Ad performance
- • Conversion rates
Results depend on multiple factors outside of our control, including market conditions, competition, product quality, pricing, and client execution.
3. High-Risk Industry Disclaimer
Harbor Point Marketing works with industries that may be subject to restrictions, including but not limited to peptides, supplements, and other regulated products.
By engaging our services, you acknowledge that:
- • You are solely responsible for ensuring your business complies with all applicable laws and regulations
- • You are responsible for your product claims, labeling, and legality
- • You accept the risks associated with operating in restricted or high-risk industries
We do not provide legal or regulatory advice.
4. Platform & Account Risk Disclaimer
We are not responsible for any actions taken by third-party platforms, including but not limited to:
- • Ad account bans or suspensions
- • Payment processor restrictions or shutdowns
- • Website hosting issues
- • Social media account penalties
These risks are inherent to the platforms and industries involved.
5. Payments & Billing
- • A non-refundable setup fee or deposit is required before work begins
- • Monthly services are billed in advance
- • Late payments may result in paused services or termination
- • All fees are non-refundable once services have been delivered
Failure to make timely payments may result in suspension of services without liability.
6. Cancellation & Termination
- • Clients may cancel services with written notice (typically 7–30 days depending on agreement)
- • No refunds will be issued for work already completed or ongoing billing cycles
- • We reserve the right to terminate services at any time due to non-payment, abuse, or breach of agreement
7. Intellectual Property
- • All deliverables remain the property of Harbor Point Marketing until full payment is received
- • Upon full payment, the client is granted rights to use final deliverables
- • We reserve the right to showcase work in our portfolio unless otherwise agreed
8. Confidentiality
We respect your confidential information and will not share it with third parties.
Clients agree to respect our proprietary systems, strategies, and internal processes.
9. Limitation of Liability
To the maximum extent permitted by law:
Harbor Point Marketing shall not be liable for:
- • Loss of revenue or profits
- • Business interruption
- • Indirect or consequential damages
Our total liability is limited to the total amount paid for services within the last 30 days.
10. Indemnification
You agree to indemnify and hold Harbor Point Marketing harmless from any claims, damages, or legal issues arising from:
- • Your products or services
- • Your marketing claims
- • Regulatory or compliance violations
- • Use of materials created on your behalf
11. Communication
We aim for clear and responsive communication. Clients are expected to:
- • Provide timely feedback
- • Supply necessary materials
- • Maintain professional conduct
Delays caused by the client may impact timelines.
